בחברה הישראלית למודת המלחמות, בה קואליציות קמות ונופלות בשל עניינים מדיניים, מאבקים ציבוריים-פוליטיים על מדיניות החינוך נדחקים אל קרן זווית. שוליותה של מדיניות החינוך בסדר היום הציבורי הכללי בולטת ומתעצמת על רקע מרכזיותה של מדיניות זו במאבקים הפוליטיים התכופים שמנהלים נציגי המפלגות החרדיות. ספר זה פותח צוהר אל השיח שהתקיים בשני העשורים האחרונים בין בתי המשפט, הכנסת ומשרד החינוך בנושא החינוך החרדי, וזורה אור על תוצאותיו והשלכותיו. הספר נפתח במבט אל מדיניות החינוך הפורמלית בישראל, בניתוח הגורמים שתרמו לעיצובה ובתיאור הפערים בין המדיניות לבין המציאות בשטח; הוא נמשך במבט השוואתי אל הקשרים בין המדיניות המשפטית לבין החינוך החרדי בארצות הברית ובאנגליה; וחותם בבחינת הזכויות והאינטרסים שיש לשקול במסגרת עיצוב מדיניות חינוך חלופית ובהצגת מתווה של הצעות קונקרטיות. לאורכו ולרוחבו, מציע הספר לקוראיו תובנות חדשות על מערכות היחסים בין משפט, תרבות ופוליטיקה במדיניות החינוך בישראל, ועל האופנים בהם מעצבות מערכות יחסים אלה את זכויות הילדות והילדים החרדים, את זכויות הוריהם ואת דמותה של הקהילה החרדית.

Agents of God: Boundaries and Authority in Muslim and Christian Schools

In Agents of God, sociologist Jeffrey Guhin describes his year and a half spent in two Sunni Muslim and two Evangelical Christian high schools in the New York City area. At first, these four schools could not seem more different, yet they are linked by much: these are all schools with conservative thoughts on gender and sexuality, with a hostility to the theory of evolution, and with a deep suspicion of secularism. And they are all also hopeful that America will be a place where their children can excel, even as they also fear the nation’s many temptations might lead their children astray. Guhin shows how these school communities use boundaries of politics, gender, and sexuality to distinguish themselves from the outside world, both in school and online. Within these boundaries, these communities have developed “external authorities” like Science, Scripture, and Prayer, each of which is felt and experienced as a real power with the ability to make commands and coerce action. For example, people can describe Science itself as showing something or the Bible itself as making a command. By offloading coercion to these external authorities, leaders in these schools are able to maintain a commitment to religious freedom while simultaneously reproducing their moral commitments in their students. Drawing on extensive classroom observation, community participation, and interviews with students, teachers, and staff, this book makes an original contribution to religious studies, sociology, and education.

Law and Religious Diversity in Education

Religion is a prominent legal force despite the premise constructed and promoted by Western constitutionalism that it must be separated from the State in democracies. Education constitutes an area of human life that leaves ample scope for the expression of religious identity and shapes the citizens of the future. It is also the place of origin of a considerable number of normative conflicts involving religious identity that arise today in multicultural settings. The book deals with the interplay of law and religion in education through the versatility of religious law and legal pluralism, as well as religion's possible adaptation and reconciliation with modernity, in order to consider and reflect on normative conflicts. It adopts the angle of the constitutional dimension of religion narrated in a comparative perspective and critically reflects on regulatory attempts by the State and the international community to promote new ways of living together.
Religious Liberty and Education

Over the last few years, Orthodox Jewish private schools, also known as yeshivas, have been under fire by a group of activists known as Young Advocates for Fair Education, run by several yeshiva graduates, who have criticized them for providing an inadequate secular education. At the heart of the yeshiva controversy lies two important interests in education: the right of the parent to choose an appropriate education, which may include values-laden religious education, and the right of each child to receive an appropriate education, as guaranteed by the state. These interests raise further questions. If preference is given to the former, how much freedom should be given to a parent in choosing an appropriate education? If the latter, how does the state define what constitutes an appropriate education or measure the extent to which an appropriate education has been achieved? And when can-or must-the state override the wishes of parents? The purpose of this book is to explore these difficult questions.
State and Religion in Israel : A Philosophical-legal Inquiry

State and Religion in Israel begins with a philosophical analysis of the two main questions regarding the role of religion in liberal states: should such states institute a 'Wall of Separation' between state and religion? Should they offer religious practices and religious communities special protection? Gideon Sapir and Daniel Statman argue that liberalism in not committed to Separation, but is committed to granting religion a unique protection, albeit a narrower one than often assumed. They then use Israel as a case study for their conclusions. Although Israel is defined as a Jewish state, its Jewish identity need not be interpreted religiously, requiring that it subjects itself to the dictates of Jewish law (Halakha). The authors test this view by critically examining important topics relevant to state and religion in Israel: marriage and divorce, the drafting of yeshiva students into the army, the character of the Sabbath and more.
