The legal status of the Temple Mount and the Western Wall derives primarily from the status of the area in which they are located: the Old City in East Jerusalem (as is well-known, the future political status of this part of the city is the most difficult issue to be solved in the peace process between Israel and the Palestinians). This paper shall first discuss the legal status of East Jerusalem, then various issues comprising the legal status of the Holy Places, the most important among them being the Temple Mount and the Western Wall.

The Holy Places of Jerusalem's Old City are among the most contested sites in the world and the 'ground zero' of the Israeli-Palestinian conflict. Tensions regarding control are rooted in misperceptions over the status of the sites, the role of external bodies such as religious organizations and civil society, and misunderstanding regarding the political roles of the many actors associated with the sites. In this volume, Marshall J. Breger and Leonard M. Hammer clarify a complex and fraught situation by providing insight into the laws and rules pertaining to Jerusalem's holy sites. Providing a compendium of important legal sources and broad-form policy analysis, they show how laws pertaining to Holy Places have been implemented and engaged. The book weaves aspects of history, politics, and religion that have played a role in creation and identification of the 'law.' Between Cultural Diversity and Common Heritage

Going beyond the more usual focus on Jerusalem as a sacred place, this book presents legal perspectives on the most important sacred places of the Mediterranean. The first part of the book discusses the notion of sacred places in anthropological, sociological and legal studies and provides an overview of existing legal approaches to the protection of sacred places in order to develop and define a new legal framework. The second part introduces the meaning of sacred places in Jewish, Christian and Islamic thought and focuses on the significance and role that sacred places have in the three major monotheistic religions and how best to preserve their religious nature whilst designing a new international statute. The final part of the book is a detailed analysis of the legal status of key sacred places and holy cities in the Mediterranean area and identifies a set of legal principles to support a general framework within which specific legal measures can be implemented. The book concludes with a useful appendix for the protection of sacred places in the Mediterranean region. Including contributions from leading law and religion scholars, this interesting book will be valuable to those in the fields of international law, as well as religion and heritage studies.
Contested Holy Places in Israel-Palestine: Sharing and Conflict Resolution

Over the last twenty years, there has been a growing understanding that conflicts in or over holy places differ from other territorial conflicts. A holy site has a profound meaning, involving human beliefs, strong emotions, "sacred" values, and core identity self-perceptions; therefore a dispute over such land differs from a "regular" dispute over land. In order to resolve conflicts over holy sites, one must be equipped with an understanding of the cultural, religious, social, and political meaning of the holy place to each of the contesting groups. This book seeks to understand the many facets of disputes and the triggers for the outbreak of violence in and around holy sites. It analyses fourteen case studies of conflicts over holy sites in Palestine/Israel, including major holy sites such as Al-Haram al-Sharif/the Temple Mount, the Western Wall and the Cave of the Patriarchs/Al-Ibrahimi Mosque in Hebron, in addition to disputes over more minor sites. It then compares these conflicts to similar cases from other regions and provides an analysis of effective and ineffective conflict mitigation and resolution tools used for dealing with such disputes. Furthermore, the book sheds light on the role of sacred sites in exacerbating local and regional ethnic conflicts. By providing a thorough and systematic analysis of the social, economic, and political conditions that fuel conflicts over holy sites and the conditions that create tolerance or conflict, this book will be a key resource for students and scholars of conflict resolution, political science, and religious studies.

Examining the religious, political and legal issues, the authors show how the holy sites have been a focus of both conflict and cooperation between different communities. Religion and religious nationalism have long played a central role in many ethnic and national conflicts, and the importance of religion to national identity means that territorial disputes can often focus on the contestation of holy places and sacred territory. Women and the Holy City: The Struggle Over Jerusalem's Sacred Space

Jerusalem's Temple Mount/al-Haram al-Sharif is the holiest place in the world for Jews, the third holiest place for Muslims and a constant feature in the Israeli-Palestinian conflict. Yet the gendered dimensions of inter-communal disputes over sacred space in Jerusalem, as well as in other holy places around the world, have been largely neglected, as have women's roles in these site-specific conflicts. An implicit association of women with peaceful politics and syncretic religious practices has obscured the fact that women are often key actors in inter-communal contestation of holy places. This study looks to three contemporary women's movements in and around Jerusalem's Sacred Esplanade: Women for the Temple - a Jewish Orthodox movement for access to Temple Mount; The Murabitat - Muslim women activists devoted to the protection of Al-Aqsa Mosque from Jewish claims; and Women of the Wall - a Jewish feminist mobilization against restrictive gender regulations at the Western Wall. Lihi Ben-Shitrit demonstrates how attention to gender and to women's engagement in conflict over sacred places is essential for understanding what makes contested sacred sites increasingly 'indivisible' for parties in the inter-communal context.

The remarkable story of the innovative legal strategies Native Americans have used to protect their religious rights From North Dakota's Standing Rock encampments to Arizona's San Francisco Peaks, Native Americans have repeatedly asserted legal rights to religious freedom to protect their sacred places, practices, objects, knowledge, and ancestral remains. But these claims have met with little success in court because Native American communal traditions don't fit easily into modern Western definitions of religion. In Defend the Sacred, Michael McNally explores how, in response to this situation, Native peoples have creatively turned to other legal means to safeguard what matters to them. In Treading on Sacred Grounds: Places of Worship, Local Planning and Religious Freedom in Australia, Noel Villaroman analyses the engagement of religious groups with local councils in Australia in their applications to build places of worship. Such applications often encounter opposition from local residents who are reluctant to share their neighbourhood or street with the newly arrived and less known 'other.' The local councils, being the planning authority that grants or refuses such applications, are caught in the middle of these disputes. Using the lens of international human rights law, the book probes the local councils' actions and their repercussions to religious freedom. The book has concrete legal and social implications that it is bound to impact not only legal scholarship but also, crucially, policy makers.
Identifying and Regulating Religion in India: Law, History and the Place of Worship

Judicial debates on the regulation of religion in post-colonial India have been characterised by the inability of courts to identify religion as a governable phenomenon. This book investigates the identification and regulation of religion through an intellectual history of law's creation of religion from the colonial to the post-colonial. Moving beyond conventional explanations on the failure of secularism and the secular state, it argues that the impasse in the legal regulation of religion lies in the methodologies and frameworks used by British colonial administrators in identifying and governing religion. Drawing on insights from post-colonial theory and religious studies, it demonstrates the role of secular legal reasoning in the background of Western intellectual history and Christian theology through an illustration of the place of worship. It is a contribution to South Asian legal history and sociolegal studies analysing court archives, colonial narratives and legislative documents.
Governing the Sacred: Political Toleration in Five Contested Sacred Sites

Holy sites are often at the center of intense contestation between different groups regarding a wide variety of issues, including ownership, access, usage rights, permissible religious conduct, and many others. They are often the source intractable long-standing conflicts and extreme violence.These difficulties are exemplified by the five sites profiled in Governing the Sacred : Devils Tower National Monument (Wyoming, US), Babri Masjid/Ram Janmabhoomi (Uttar-Pradesh, India), the Western Wall (Jerusalem), the Church of the Holy Sepulchre (Jerusalem), and the Temple Mount/Haram esh-Sharif(Jerusalem). Telling the fascinating stories of these high-profile contested sites, the authors develop and critically explore five different models of governing such sites: "non-interference," "separation and division," "preference," "status-quo," and "closure." Each model relies on different setsof considerations; central among them are trade-offs between religious liberty and social order. This novel typology aims to assist democratic governments in their attempt to secure public order and mutual toleration among opposed groups in contested sacred sites.
