חסי הורים וילדים : בין דיני משפחה לבין דיני חוזים by
בשנים האחרונות הולך וגובר יישומם של חוזים והסכמים שונים ומגוונים בתוככי המשפחה, הן במישור האופקי הזוגי והן במישור האנכי שבין הורים וילדיהם. בממשק שבין דיני משפחה לדיני חוזים בתחום הזוגיות יש כבר ספרות ענפה. ספר זה, המסכם מחקר של למעלה מעשר שנים, ממלא את החסר במחקר אקדמי מקיף ומעמיק בקשרי הורים וילדים. הספר הוא הראשון המתפרסם בישראל, ואחד החלוצים בעולם, העוסק בתפר שבין דיני המשפחה ודיני החוזים בכל הנוגע ליחסי הורים וילדים. במוקד הספר עומד יישומו של הממשק שבין דיני משפחה ובין דיני חוזים על בסיס האני מאמין המחקרי של המחבר – קביעת הורות משפטית בהסכמה בישראל – על השלכותיו בסוגיות שונות ומגוונות לאורך חיי הזוגיות וההורות. המדובר, בראש ובראשונה, בקביעת דמות ההורים המשפטיים של הילד סביב לידתו. עם זאת, הספר דן לעומק בממשק ייחודי זה במנעד סוגיות והקשרים לאורך חיי הזוגיות וההורות: לפני לידת הילד, במהלך חיי הנישואים או השיתוף הזוגי, ועם פירוק התא המשפחתי מחמת גירושין או פטירת ההורים. המחבר הוא פרופסור חבר בבית הספר למשפטים במכללה האקדמית נתניה ומרצה מן החוץ במספר פקולטות ובתי ספר למשפטים. תחומי מומחיותו משתרעים על שדות דיני המשפחה, דיני החוזים, המשפט העברי, וביו-אתיקה. המחבר עוסק בהוראת תחומים אלו באקדמיה מזה קרוב לשני עשורים. את הפוסט כתב את הדוקטורט באוניברסיטת ניו יורק (NYU), שם שימש כחוקר אורח בשנים 2012-2011. פרסם שני ספרים בהוצאת הספרים של אוניברסיטת קיימברידג' ועשרות מאמרים בכתבי עת מובילים בחו"ל ובישראל
הסתלקות בחוק הירושה by
חוק הירושה מאפשר לאדם, באמצעות עריכת צוואה, לקבוע מי יהיו יורשיו. המצווה אינו מחויב לערוך צוואה שהזוכים בה יהיו יורשיו על פי דין, אלא הוא רשאי לקבוע את יורשיו בהתאם לרצונו וכן את החלק והמנה שיקבל כל זוכה וזוכה מתוך עיזבונו. זכות זו של המצווה היא צד אחד של המטבע. הצד השני הוא רצונו של הזוכה על פי צוואה או היורש על פי דין של המוריש שלא לרשת את העיזבון. זכות זו, שהיא הזכות להסתלק מזכות בעיזבון, מוסדרת בסעיף 6 לחוק הירושה ובזכות זו עוסק ספר זה. הספר מתמקד בסוגית ההסתלקות בירושה ומאגד בתוכו את פסיקת בתי המשפט שנצברה לאורך השנים ומכל הערכאות. הוא סוקר באופן מקיף ומעמיק את ההלכות הנוגעות לסוגיה זו, הן כאשר מדובר בהסתלקות מצוואה והן כאשר מדובר בהסתלקות מירושה על פי דין. מטרתו של ספר זה היא לסייע לעורכי הדין בפרקטיקה בכל הקשור לסוגית ההסתלקות וכן להניח בפני שופטים, את התמונה הפסיקתית המלאה אשר נבנתה לאורך השנים בערכאות המשפטיות השונות. מחברת הספר, עו"ד אילנית שבת (חלפון), היא עורכת דין בעלת ותק של 27 שנות נסיון בעריכת דין בכלל ובייצוג בדיני המשפחה וירושה בפרט. המחברת היא בעלת תואר מוסמך במשפטים מאוניברסיטת בר אילן (במסלול מחקרי). במסגרת לימודיה אלה, השלימה המחברת עבודת תזה נרחבת בסוגיית חלוקת ההון האנושי בין בני זוג אגב גירושין וזכתה בפרס הרקטור על הצטיינות מיוחדת. את לימודי התואר השני סיימה המחברת בהצטיינות יתרה. בשנת 2006 פרסמה עו"ד שבת (חלפון) את ספרה הראשון ירושה – עסקאות בירושה עתידה וצוואות הדדיות העוסק בסעיפים 8 ו-8א לחוק הירושה. ספרה הנוכחי של המחברת בסוגית ההסתלקות בירושה הוא ספר נוסף בתחום דיני הירושה וזה עוסק בסעיף 6 לחוק הירושה.

While continental and comparative lawyers have recently rediscovered succession law as an area of immense practical importance deserving greater academic attention, it is still a neglected field in England. This book aims to reinvigorate the English debate. Succession Law, Practice and Society in Europe Across the Centuries by
This book presents a broad overview of succession law, encompassing aspects of family law, testamentary law and legal history. It examines society and legal practice in Europe from the Middle Ages to the present from both a legal and a sociological perspective. The contributing authors investigate various aspects of succession law that have not yet been thoroughly examined by legal historians, and in doing so they not only add to our knowledge of past succession law but also provide a valuable key to interpreting and understanding current European succession law. Readers can explore such issues as the importance of a father's permission to marry in relation to disinheritance, as well as inheritance transactions and private, dynastic and cross-border successions. Further themes addressed by the expert contributors include women's inheritance rights, the laws of succession for the prince in legal consulting, and succession in the Rota Romana's jurisprudence.
Comparative Succession Law: Volume II: Intestate Succession by
Intestate Succession is the second volume in the Comparative Succession Law series which examines the principles of succession law from a comparative and historical perspective. This volume discusses the rules which apply where a person dies either without leaving a valid will, or leaving a will which fails to dispose of all of the person's assets. Among the questions considered are the following: What is the nature of the rules for the disposal of the deceased's assets? Are they mechanical or is there an element of discretion? Are particular types of property dealt with in particular ways? Is there entitlement to individual assets (as opposed to money)? Do the rules operate in a parentelic system or a system of some other kind? Are spouses treated more favourably than children? What provision is made for extra-marital children, for adopted children, for step-children? Does cohabitation give rise to entitlement? How are same-sex couples treated? Broader questions also arise of a historical and comparative nature. Where, for example, do the rules in intestate succession come from in particular legal systems? Have they been influenced by the rules in other countries? How are the rules explained and how are they justified? To what extent have they changed over time? What are the long-term trends? And finally, are the rules satisfactory, and is there pressure for their reform? As in the first volume, this book will focus on Europe and on countries which have been influenced by the European experience such as Australia, New Zealand, South Africa, the United States of America, Quebec, and the countries of Latin America. Further chapters are devoted to Islamic Law and Nordic law. Comparative Succession Law: Volume III: Mandatory Family Protection by
This third volume in a series on Comparative Succession Law concerns the entitlement of family members to override the provisions of a deceased person's will to obtain money or assets (or more money or assets) from the person's estate. Some countries, notably those in the civil law tradition (such as France or Germany), confer a pre-ordained share of the deceased's estate or of its value on certain members of the deceased's family, and especially on the deceased's children and spouse. Other countries, notably those in the common law tradition (such as England, Canada, or Australia), leave the matter to the discretion of the court, the amount awarded depending primarily on financial need. Whichever form it takes, mandatory family provision is both a protection against disinheritance and also, therefore, a restriction on testamentary freedom. The volume focuses on Europe and on countries influenced by the European experience. In addition to detailed treatment of the law in Austria, England and Wales, France, Germany, Hungary, Italy, the Netherlands, Norway, Poland, Scotland, and Spain, the book also has chapters on Australia and New Zealand, South Africa, the United States, Canada, the countries of Latin America, and the People's Republic of China. Some other countries are covered more briefly, and there is a separate chapter on Islamic law. The book opens with accounts of Roman law and of the law in medieval and early-modern Europe, and it concludes with a comparative assessment of the law as it is today in the countries and legal traditions surveyed in this volume.
Exploring the Law of Succession : Studies National, Historical and Comparative by
By comparison with other areas of private law, the law of succession has been neglected by modern scholars. This volume contributes to its rehabilitation by examining key issues in succession law from a variety of perspectives: national, historical and comparative. In particular it seeks to extend the techniques of legal comparison into an area of law where hitherto they have been little used. The jurisdictions most prominently featured are the mixed jurisdictions of Scotland and South Africa, but there are frequent comparative references, and special attention is given to the Netherlands as the country which has most recently re-written its succession law. The authors of the individual chapters are drawn from Scotland, South Africa, Germany, Italy and the Netherlands. Among the topics covered are freedom of testation, testamentary conditions and public policy, forfeiture clauses and events, revocation of wills by changed circumstances, revocation of mutual wills, fideicommissary substitutions, and succession agreements. The volume opens with an overview of the state of comparative law and with a consideration of compulsory heirship in Roman law.
